Courts Disqualifies Akan Udofia, Orders Fresh APC Guber Primary in Akwa Ibom

The Federal High Court sitting in Uyo on earlier today has nullified the All Progressives Congress (APC) governorship primary election that produced Obong Akanimo Udofia as the flagbearer of the party in Akwa Ibom State ahead of next year’s general elections.
 Justice Agatha Okeke, ordered that a fresh primary poll be conducted within 14 days of the judgment.
“Within fourteen days only, the party (APC) should conduct fresh primary” the court said.
Governorship aspirant in the Akwa Ibom APC governorship primary held on May 26 2022, Senator Ita Enang had sued Obong Akanimo Udofia, the APC and the Independent National Electoral Commission (INEC), as the first, second and third defendants respectively, challenging the legitimacy of the conduct of the primary.
In determining the substantive suit, the judge noted that the APC Governorship Election Committee violated the laid down provisions of the electoral act 2022 as amended.
The judge also noted that there was no evidence before the court that the procedures adopted by the second defendant (APC) was held.
Justice Okeke also held that the aspirants were not given equal opportunity to campaign. She resolved that the weight of evidence before the court showed that no election was held and that the nomination of Obong Akanimo Udofia “was null and void and therefore set aside.”
“No APC governorship primary election was held in Akwa Ibom. Therefore, the nomination of the first defendant (Udofia) as the governorship candidate did not comply with the Electoral Act of 2022,” the judge held.
The judge described the Akwa Ibom governorship primary election held on May 26, 2022, as a “sham,” adding that “the second defendant (APC) is restrained from presenting its candidate (Udofia) to the third defendant (INEC) for the 2023 general election.
Justice Okeke ordered that “the second defendant shall, within 14 days, conduct a fresh election of the judgment and also ordered that the first defendant (Udofia) be disqualified from participating in the fresh primary”.

INEC Offices Security to be Reinforced by Army, DSS

In reaction to recent attacks  on the offices of the Independent National Electoral Commission, the Department of State Services and the Nigerian Army will henceforth provide additional security for the facilities nationwide.

The move was agreed upon at the emergency meeting of the Inter-Agency Consultative Committee on Election Security (ICCES) held on Friday in Abuja.

National Commissioner and Chairman, Security Committee of INEC, Maj. Gen. Modibbo Alkali (rtd) disclosed the resolutions of the meeting in a statement on Saturday.

He said: “With 105 days to the 2023 General Election, the meeting noted with grave concerns the recent attacks on INEC facilities in Ogun and Osun States.

“Similarly troubling is the rising incidents of attacks on supporters and facilities of political parties, ostensibly by political opponents, so soon into the five-month period for campaign rallies, processions and meetings as provided in the INEC Timetable and Schedule of Activities for the 2023 General Election.

” It is even more worrisome that these are happening as several electoral activities that will precede the elections are in progress such as the display of the register of voters for claims and objections nationwide.

“Following extensive reports, reviews and deliberations, the meeting arrived at the following resolutions:

“Security agencies will upscale intelligence gathering, sharing and utilisation of same to stem further sabotage.

“Deployment of joint Security and Safety Teams to all INEC assets and facilities nationwide forthwith. The teams will include, among others, the Police, Army, DSS, Civil Defence and the Federal Fire Service.

“In addition to the measures already taken for the arrest and prosecution of offenders, the Inspector General of Police, as head of the lead agency in internal security, shall convene a meeting of all political parties, candidates and other critical stakeholders to reiterate the imperative of peaceful campaign and to convey the enforcement measures to be taken against violators.

“Decisive lawful action shall be taken against purveyors of hate speech, incitement to violence, mobilisation of thugs and other violations, including the prompt arrest, investigation and prosecution of offenders in line with the provisions of Sections 92 and 93 of the Electoral Act 2022. Those already arrested will face prosecution immediately.

“The meeting appealed to Nigerians to continue to support INEC and the security agencies to ensure a peaceful and secure environment for the 2023 General Election.

INEC Office set Ablaze in Ogun State

The office of the Independent National Electoral Commission; INEC at Iyana Mortuary lll in Abeokuta, the Ogun State capital has been set on fire.

Hoodlums, numbering about eight were said to have mede their way into the premises to set the INEC building on fire from behind with loaves of bread soaked in petrol which was thrown into the building at different angles to light up the INEC office.

It was further gathered that a security guard at the facility identified as Azeez Hamzat, had made a distress call to the police around 1am alerting them on the fire incident.

The police from Ibara division reportedly mobilised detectives to the scene and later contacted men of fire service in the state , who raced to the scene to put out the fire.

The Ogun INEC Resident Electoral Commissioner, Niyi Ijalaye confirmed the incident, describing it as shocking, but assured that the situation was still being assessed.

The store, the Registration Area Officer’s office, and the conference room alongside some non-sensitive materials were said to have been burnt, thankfully, no life was lostOgun .
