Judgement on Sylva’s Petition Against Diri On Indefinite Hold Over Claims of Bias

The All Progressives Congress;APC and its candidate in the Bayelsa State governorship poll, Timipre Sylva, have accused the election petition tribunal sitting in Abuja of bias.

The Party demanded the outright disbandment of the tribunal headed by Justice Adekunle Adeleye and the reconstitution of a separate panel to oversee the petitions.

The APC and Timipre Sylva, are challenging the re-election of Governor Duoye Diri, and his deputy, Lawrence Ewhrujakpo, in the November 11, 2023 governorship election.

The Independent National Electoral Commission had declared Diri the winner of the election after polling 175, 196 votes to defeat his closest rival, Sylva of the APC who scored 110,108 votes.

Dissatisfied, Sylva and the APC approached the tribunal to challenge the declaration of Diri as the winner of the poll.

Sylva and his party had closed their case at the tribunal at the last proceedings after calling their witnesses, including a former Commissioner of Police in the state, Akeem Alausa.

At the proceedings on Monday, the tribunal Chairman, Justice Adeleye, announced that a petition questioning the members’ neutrality and integrity and seeking indefinite adjournment in the hearing of the case had been filed.

In the petition dated March 4, 2024, the petitioners accused the tribunal of denying them their constitutional right to a fair hearing as required by law.

They contended that the seven days given to them by the tribunal was not enough to field their 234 witnesses and it was tantamount to denying them a fair hearing.

They said they planned calling 25 witnesses per day but the tribunal limited them to eight witnesses daily.

They alleged that the situation forced them to close their case prematurely without calling all their witnesses.

In the face of this impossible situation, the petitioners had no choice but to close their case on Tuesday 27th February 2024 after calling only 49 witnesses out of the 234 witnesses,” they said.

The petitioners also claimed that the tribunal distorted the oral testimony of their witnesses in the record of proceedings and had also made findings and decisions in respect of the authenticity and weight of polling unit election results they tendered.

Upon the perusal of the record of proceedings, we were perplexed to find that the tribunal had already made their findings and decisions with respect to the authenticity and weight of the documents (polling unit results) tendered by the petitioners even before the conclusion of the case. Examples are to be found on several pages of the record of proceedings, such as page 93 where the tribunal wrote as follows: Tribunal members – Observation in open court shows that the same pattern of writing was employed, “the petition added.

The petitioners said it had become obvious that they could not get justice from the tribunal.

They said, “It is obvious from the forgoing that the petitioners cannot get justice from the tribunal as presently constituted, since it is obvious that the tribunal chairman has descended into the arena of the legal conflict between the parties.

“In the light of the abnormalities mentioned above, we respectfully request Your Lordship to disband the membership of the Tribunal and reconstitute same urgently.

“As earlier indicated above, we have up till May 28, 2024, before the lifespan of the tribunal will expire. So there is still enough time for a new tribunal to start de novo and conclude the trial within the constitutional lifespan of 180 days.

Also, in a separate letter they brought to the tribunal through their counsel, R. O. Balogun, the APC and Sylva demanded that the tribunal should adjourn proceedings in the matter indefinitely pending the time the Court of Appeal President will come out with a decision on the petition.

In a short ruling, Justice Adeleye adjourned the matter sine die (indefinitely).

He noted that they would wait for the decision of the Court of Appeal President on the allegations against the tribunal.

Army Neutralizes ESN Terrorists in Imo

The Nigerian Army troops say they successfully cleared IPOB/ESN hideout at Ihiteukwa Community in Orsu Local Government Area of Imo State, neutralising one IPOB/ESN terrorist after an intense firefight on Saturday.

The Director of Army Public Relations, Maj.-Gen. Onyema Nwachukwu, made this known in a statement on Sunday in Abuja. Nwachukwu said the troops conducted a search in their hideout and recovered three Improvised Explosive Devices (IEDs), one Toyota Highlander SUV, and one Hilux vehicle after overpowering the criminals.

He said that other items recovered include eight rounds of 7.62mm (Special) ammunition, six rounds of 7.62mm (NATO) ammunition, and one locally fabricated single barrel gun.

Other items recovered from the terrorists’ hideout include a pair of proscribed Biafran uniforms, one solar panel, and one CCTV camera.

Troops also recovered 10 mobile phones, batteries, a bundle of proscribed Biafran currency, three solar street lights, three jungle hats, pairs of black boots, and assorted charms,” he said.

Nwachukwu said the troops had, in another encounter, engaged IPOB/ESN terrorists at their crossing point in the Akawa Nneato area of Umunneochi Local Government Area of Abia.

He said the troops engaged the terrorists in a firefight, resulting in the terrorists scampering in disarray into nearby bushes.

On exploiting further after the shootout, troops recovered one AK-47 rifle loaded with 19 rounds of 7.62mm (Special) ammunition, two empty magazines, and one FN rifle loaded with four rounds of 7.62mm (NATO) ammunition.

“In another development, troops operating in the Kawara general area of Birnin Gwari Forest in Kaduna State have cleared and destroyed a series of terrorists’ camps in the area.

“During the operation, troops recovered three motorbikes, one PKT Gun link containing 246 rounds of 7.62mm by 39mm ammunition, one woodland camouflage, and a pair of Desert boots.

“Other items recovered include three magazine carriers and one Boafeng Radio.

“Troops have dominated the general area and conducting further exploits in pursuit of the insurgents.

The Nigerian Army remains committed to ensuring the safety and security of citizens and will continue to sustain operations to sanitise troubled areas in order to restore peace and stability in the country,” he added.

Customs Set to Resume Auction and Distribution of Seized Food Items

The Nigeria Customs Service, Oyo/Ogun Command, has announced plans to begin another round of distribution of seized rice and other food items to citizens as soon as the Federal Government finalises the modalities for the exercise. The Service says this is a move to alleviate the hardship Nigerians are facing due to the skyrocketing prices of food in the country.

According to the command, the modalities for the distribution exercise became necessary to prevent a repeat of the tragic incident recalled in Lagos, where scores of people died when armed hoodlums in camouflage gear attempted to force their way into the venue.

Recall that the Nigeria Customs began the distribution of seized food items on the order of the Federal Government to Nigerians to help mitigate the current hardship in the country.

While speaking with newsmen at the command headquarters in Ibadan, yesterday, the Area Controller, Oyo/Osun Command, Ben Oramalugo, said that in light of the current food shortage and rising prices, the federal government has directed the Nigeria Customs Service to distribute seized rice at a cheaper price to the public to alleviate the suffering of Nigerians and make sure that they have access to affordable food.

He said that the distribution of the seized items would go a long way in alleviating the hardship being faced by many families, while adding that they are taking the directive very seriously, and are committed to ensuring that the seized rice is distributed fairly and transparently, with eligible beneficiaries carefully screened and verified before they receive the items.

In his words, “Once the necessary modalities are in place, the distribution of seized rice will begin. We will provide regular updates to the public on the progress of the distribution.”

In the meantime, we would like to remind everyone that smuggling is illegal and that those who engage in it are subject to serious penalties.”

We urge everyone to support the government’s efforts to crack down on smuggling and ensure that only legal goods are brought into the country.”

Rivers United Snatch Late Qualification in Uyo

Enyinnaya Kazie Godswill’s last minute goal gave Rivers United of Nigeria a dramatic 2-1 win over Dreams FC of Ghana on Sunday, at the Godswill Akpabio International Stadium, Uyo to confirm their place in the CAF Confederation Cup quarter-finals.

Dreams FC won Group C on goal difference over Rivers after both west African clubs accumulated 12 points from six matches.

Club Africain of Tunisia spoilt their chances of securing a place in the knockout stage of the Confederations Cup after being surprisingly held 1-1 by Academica Lobito of Angola.

The Tunisians finished the most hotly contested of the four mini-leagues with 10 points while Lobito managed just one.

Modern Future and Zamalek of Egypt, title-holders USM Alger of Algeria, Abu Salim of Libya, Renaissance Berkane of Morocco and Stade Malien of Mali are the other quarter-finalists.

Berkane twice, Zamalek, USM and Stade have won the Confederation Cup while Salim, Dreams and Future are first-time qualifiers for the knockout stage.

Hoping to become the first Nigerian winners of a CAF competition since Enyimba lifted the 2005 Super Cup, Rivers fell behind after 40 minutes in Uyo when Abdul Aziz Issah scored for Dreams.

Echeta Deputy levelled on the hour mark and the Ghanaians were reduced to 10 men after 81 minutes when Seth Agyemang was sent off after being yellow-carded a second time.

Full-back Godswill then temporarily abandoned his defensive duties to score the goal that booked Rivers a place in the last-eight draw on a date to be announced.
